1. Acceptance of Terms
By accessing or using LoadJunky.com (the "Site") or any associated services, including but not limited to the LoadJunky load broadcast SMS system (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Services.
The Services are operated by Liquidation Motivation LLC, a New York limited liability company ("LoadJunky," "we," "us," or "our").
2. Eligibility
The Services are intended exclusively for business use within the wholesale freight, liquidation, and trucking industries. You represent that you are at least 18 years of age, authorized to act on behalf of the business you represent, and not prohibited from receiving services under U.S. law.
3. Account and Verification
Buyer, seller, broker, and carrier accounts on LoadJunky are subject to verification of business information including (where applicable) MC numbers, USDOT numbers, and insurance certificates. You agree to provide accurate information and to update it as needed. We may suspend or remove accounts that misrepresent identity or violate these Terms.
4. The LoadJunky SMS Broadcast System
The SMS broadcast system sends text messages from a designated LoadJunky phone number to freight brokers who have explicitly opted in. The following terms apply to all participants in the SMS system:
Consent
You will receive SMS messages from LoadJunky only after providing explicit verbal or written consent in a one-to-one conversation with a LoadJunky representative. We do not buy, sell, rent, or scrape phone number lists.
Message Frequency & Cost
Frequency varies based on load availability — typically 0 to 10 messages per week per broker. Message and data rates may apply. Check with your mobile carrier.
STOP and HELP Keywords
Reply STOP to any LoadJunky message to immediately unsubscribe from all SMS broadcasts. Reply START to resubscribe. Reply HELP for assistance, or contact us directly using the information in Section 12.
Replies and Quotes
When brokers reply with a dollar amount in response to a broadcast, that reply is treated as a good-faith quote to perform the shipment described. The broker who submits the lowest qualified bid by the close of the bidding window receives a confirmation message. Replies that contain only "STOP," "START," or "HELP" are processed as keyword commands and are not treated as quotes.
Mobile Information Sharing
Mobile information collected for SMS broadcasts is used solely to deliver the load alerts you signed up for. We do not sell or share mobile phone numbers or SMS opt-in data with third parties for marketing or promotional purposes. See our Privacy Policy for full details.
5. Acceptable Use
You agree not to use the Services to:
- Submit false or misleading load information or fraudulent quotes.
- Solicit business outside the load broadcast that you received the SMS for.
- Impersonate another business or broker.
- Resell, redistribute, or scrape data from LoadJunky.
- Send abusive, threatening, or unlawful content via any LoadJunky channel.
- Interfere with the security or operation of the Site or the SMS system.
Violation of these terms may result in account suspension, removal from the broker network, and notification of carriers where appropriate.
6. Load Information and Awards
LoadJunky aggregates and broadcasts load information provided by sellers, shippers, and the LoadJunky operator. While we strive for accuracy, we make no warranty about the accuracy or completeness of any specific load detail. Bidders are responsible for confirming details directly with the shipper before pickup.
The award of a load to the lowest qualified bid is a system-generated outcome based on the bidding rules. LoadJunky reserves the right to disqualify bids that violate these Terms or that LoadJunky reasonably believes were not made in good faith.
7. Fees and Payment
Buyer accounts are free. Seller accounts on LoadJunky require a monthly subscription fee disclosed at the time of registration. Carrier accounts are free for participating in the broker SMS network during the test phase. We may modify pricing on notice; continued use after notice constitutes acceptance.
8. Intellectual Property
The LoadJunky name, the LoadJunky logo, and all content, software, and design of the Site and the SMS broadcast system are owned by Liquidation Motivation LLC. You may not copy, modify, or distribute LoadJunky materials without our written consent.
9. Disclaimers
The Services are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted or error-free, or that any bid, broadcast, or other information will be delivered on time or at all.
10. Limitation of Liability
To the maximum extent permitted by law, Liquidation Motivation LLC, its members, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to lost profits, lost data, business interruption, or shipment delays. Our total cumulative liability to you for any claim shall not exceed one hundred U.S. dollars (USD $100).
11. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising out of or relating to the Services shall be resolved exclusively in the state or federal courts located in Jefferson County, New York, and you consent to the jurisdiction of those courts.

13. Changes to These Terms
